These Terms of Use govern your access to and use of the Finwell AI website at finwellai.com.au (the "Site"), operated by Finwell AI.
Please read these Terms before using the Site. By accessing the Site or submitting the waitlist survey, you agree to be bound by them. If you do not agree, please do not use the Site.
1. About the Site
Finwell AI is a pre-launch Australian fintech product. The Site currently operates as an informational landing page and a survey-based waitlist for an AI bookkeeping product under development.
Nothing on the Site constitutes a binding offer to supply any product or service. Joining the waitlist does not guarantee access to any future product, pricing tier, or feature set described on the Site.
2. Who May Use the Site
The Site is intended for adults aged 18 and over who are considering the use of an AI bookkeeping product for a business purpose. By using the Site, you represent that you are at least 18 years old.
The Site is directed at users in Australia. We make no representation that the content or any future product complies with the laws of any jurisdiction outside Australia. If you access the Site from outside Australia, you do so at your own risk and are responsible for compliance with local laws.
3. Waitlist and Survey
When you submit the waitlist survey, you agree to:
- Provide accurate and complete information
- Not submit another person's personal details without their knowledge and consent
- Not use automated tools, bots, or scripts to submit the form
We use the information you provide solely for the purposes described in our Privacy Policy. Joining the waitlist does not create any contractual obligation on either party. We reserve the right to close, pause, or restructure the waitlist at any time without notice.
4. Intellectual Property
All content on the Site — including text, graphics, the Finwell AI name, logo, and product descriptions — is owned by or licensed to Finwell AI and is protected by Australian copyright law and applicable intellectual property laws.
You may view and print pages from the Site for your own personal, non-commercial reference. You may not copy, reproduce, republish, adapt, distribute, or create derivative works from any content on the Site without our prior written consent.
Nothing in these Terms grants you any licence to use the Finwell AI name, logo, or other trade marks.
5. Acceptable Use
You agree not to use the Site in a way that:
- Violates any applicable Australian law or regulation
- Is fraudulent, misleading, or deceptive
- Infringes the intellectual property rights of any person
- Introduces malware, viruses, or other harmful code
- Interferes with the operation of the Site or the servers that host it
- Attempts to gain unauthorised access to any part of the Site or its infrastructure
- Harasses, abuses, or harms any other person
We reserve the right to restrict or terminate access to the Site for any person who breaches these Terms.
6. Third-Party Links and Services
The Site may contain links to third-party websites or reference third-party tools and services. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or availability of any third-party site.
Your use of any third-party service is governed by that service's own terms and privacy policy.
7. Disclaimers and Limitation of Liability
The Site and its content are provided on an "as is" basis. To the maximum extent permitted by law, we exclude all warranties, representations, and conditions — express or implied — relating to the Site, its content, or any future product.
In particular, we do not warrant that:
- The Site will be available at all times or free from errors
- Any information on the Site is accurate, complete, or current
- The Site is free from security vulnerabilities
Nothing on the Site constitutes financial, accounting, legal, or tax advice. The product is under development and all descriptions of features, pricing, and availability are indicative only.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including any consumer guarantee that cannot lawfully be excluded. To the extent our liability cannot be excluded under the Australian Consumer Law, our liability is limited to the extent permitted by section 64A of the Australian Consumer Law.
Subject to the above, and to the maximum extent permitted by law, our total liability to you for any loss or damage arising out of or in connection with your use of the Site is limited to AUD $100.
We are not liable for any indirect, incidental, special, or consequential loss, including loss of profits, loss of data, or loss of business opportunity, even if we have been advised of the possibility of such loss.
8. Privacy
Our collection and handling of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Site, you agree to our Privacy Policy.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New South Wales and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that state and the Federal Court of Australia.
10. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect any changes. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms. If a change is material, we will make reasonable efforts to notify waitlist members by email before the change takes effect.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.
