Finwell AI operates the website finwellai.com.au (the "Site"). This Privacy Policy explains how we collect, use, store, and disclose your personal information. It is written to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) contained in Schedule 1 of that Act.

By using the Site or submitting our waitlist survey, you acknowledge you have read this policy.

Who We Are

Finwell AI is an Australian business developing an AI-powered bookkeeping product. The Site currently operates as a landing page and pre-launch waitlist. All privacy enquiries should be directed to Alex at info@finwellai.com.au.

How does Finwell AI collect your data?

When you complete the waitlist survey, we collect the following information directly from you:

Your name
Your email address
An optional consent flag indicating whether you agree to receive future marketing communications from us

We also collect responses to nine survey questions:

How you primarily earn your income (PAYG employee, ABN sole trader, both, business owner, or investment property owner)
Your approximate annual income range
Whether you have lost or forgotten a tax receipt in the past twelve months
Your level of stress preparing tax or BAS, on a scale of 1 to 10
Your confidence that you claim every deduction you are entitled to, on a scale of 1 to 10
Which product features matter most to you (multiple-choice)
Which signals would build your trust in a platform that connects to spending data (multiple-choice)
Your preferred monthly price tier
Whether you would pay more to earn points or rewards

Note on survey responses: several of these questions — particularly your income range, your deduction-confidence rating, and your preferred price tier — may, in context, reveal information about your financial circumstances or priorities. We treat this information with the same care as any other personal information and do not use it for any purpose other than those described in this policy.

We do not collect sensitive information as defined by the Privacy Act (such as health, biometric, or government-identifier data). If this changes before launch, we will update this policy.

How We Use Your Information

We use the information you provide to:

Manage the Finwell AI waitlist and contact you about the product launch
Understand the needs and priorities of our prospective users so we can build a better product
Respond to enquiries you send us
Comply with legal obligations

If you have given separate consent, we may also use your email address to send you product news and updates. You can withdraw this consent at any time by emailing info@finwellai.com.au or clicking the unsubscribe link in any email we send.

We do not use your information for automated decision-making or profiling that produces legal or similarly significant effects.

Cookies and Tracking Technologies

The Site uses cookies and similar technologies for the following purposes:

Strictly necessary — required for the core operation of the Site, including Netlify Forms session handling for the waitlist survey. These are set without requiring your consent.
Statistics — Google Analytics 4 (GA4), operated by Google LLC, with IP anonymisation enabled. GA4 records anonymised usage data including pages visited, session duration, and general geographic region. Data is retained for 14 months.
Security / spam protection — Google reCAPTCHA v3, operated by Google LLC. Loaded only when you interact with the waitlist survey form. reCAPTCHA analyses form submission behaviour to score the likelihood that the submission is automated.

You can disable analytics and security cookies for this Site at any time using your browser's "Do Not Track" setting or by opting out of Google Analytics via the Google Analytics opt-out browser add-on. Browser-level controls (clearing cookies, blocking third-party cookies, private browsing) also work.

Third-Party Services and Data Flows

Your personal information is handled by the following third-party service providers. Where a provider is based outside Australia, we take reasonable steps to ensure they handle your information in a manner consistent with the APPs.

Netlify (United States) The Site is hosted on Netlify, Inc. Netlify stores waitlist form submissions on servers located in the United States, with global edge caching. Form submission data is retained on Netlify's infrastructure for 30 days. Netlify's infrastructure also sends email notifications of new submissions to info@finwellai.com.au. Netlify's privacy policy is available at netlify.com/privacy.

HubSpot (United States) When you submit the waitlist survey, the data you provide is transferred to HubSpot, Inc. via a serverless function. HubSpot acts as our customer relationship management (CRM) platform. Your contact data is retained in HubSpot indefinitely until you request deletion. HubSpot's privacy policy is available at legal.hubspot.com/privacy-policy.

Google Analytics 4 (United States) Anonymised analytics data is sent to Google LLC via GA4 with IP anonymisation enabled. This data does not include your name or email address. Data is retained for 14 months. Google's privacy policy is available at policies.google.com/privacy.

Google reCAPTCHA v3 (United States) When you interact with the waitlist survey form, reCAPTCHA v3 processes behavioural signals from your browser to generate a spam-risk score. This is provided by Google LLC. Google's privacy policy applies as above.

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.

Does Finwell AI share data overseas?

Some of our service providers store or process your data outside Australia, primarily in the United States. Where we disclose personal information to overseas recipients, we take reasonable steps — including relying on contractual protections and service providers' compliance programmes — to ensure those recipients handle the information consistently with the APPs. By submitting your information, you acknowledge that this cross-border handling may occur.

How long does Finwell AI keep your data?

Contact and survey data in HubSpot: retained indefinitely until you request deletion
Form submission data in Netlify: retained for 30 days from submission
Analytics data in GA4: retained for 14 months

After the applicable retention period, data is deleted or anonymised in accordance with each provider's standard processes.

What are your rights under Australian privacy law?

Under the Privacy Act 1988 and the APPs, you have the right to:

Access the personal information we hold about you (APP 12)
Correct personal information that is inaccurate, out of date, incomplete, or misleading (APP 13)
Complain about a breach of the APPs

To exercise your access or correction rights, or to request deletion of your data, email info@finwellai.com.au. We will respond within a reasonable time and in any event within 30 days.

If you are not satisfied with our response to a complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

Children

The Site and our waitlist are intended for adults who operate or work within a business. We do not knowingly collect personal information from anyone under the age of 18. If you believe we have inadvertently collected information from a minor, please contact us at info@finwellai.com.au and we will delete it promptly.

Security

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These steps include relying on the security practices of our service providers (Netlify, HubSpot, Google) and restricting access to personal information within our team.

No method of internet transmission is completely secure. If you have concerns about the security of your data, contact us at info@finwellai.com.au.

Changes to This Policy

We may update this policy as the product and its data practices develop. The "Last updated" date at the top of this page reflects when changes were last made. Material changes will be communicated via the Site or, where we hold your email address, directly to you.
